Acceptable Use Policy

1Purpose

Nyasa Cloud provides shared infrastructure used by many customers. This policy exists to keep our network secure, reliable and fast for everyone — and to make sure Nyasa Cloud is never used to cause harm. Violations of this AUP are also violations of our Terms of Service.

2Prohibited Content

You may not use Nyasa Cloud services to host, store, transmit, publish or link to:

• Content that is illegal under the laws of Malawi or any jurisdiction in which the content is accessible;
• Child sexual abuse material (CSAM) in any form — this will be reported to the relevant authorities immediately and the account terminated without notice;
• Content that infringes copyright, trademark, or other intellectual property rights without authorisation;
• Malware, viruses, ransomware, exploits, or tools designed to gain unauthorised access to systems;
• Phishing pages, fake login pages, or content designed to deceive users into giving up personal or financial information;
• Content that promotes or incites violence, terrorism, or hatred against individuals or groups;
• Content related to illegal gambling, unlicensed pharmaceuticals, or other goods/services illegal in Malawi.

3Prohibited Activity

You may not use Nyasa Cloud services to:

• Send unsolicited bulk email ("spam"), or use email lists obtained without consent;
• Conduct denial-of-service (DoS/DDoS) attacks, port scanning, or other attacks against any network;
• Attempt to gain unauthorised access to other accounts, servers, or networks ("hacking");
• Run open proxies, open relays, or services that facilitate anonymous abuse;
• Mine cryptocurrency in a way that degrades shared server performance for other customers (permitted on dedicated VPS resources within fair-use limits);
• Engage in any activity that could damage, disable, overburden or impair Nyasa Cloud's infrastructure or that of our upstream providers.

4Email & Anti-Spam Policy

Our email hosting and shared hosting plans include built-in spam and virus filtering (powered by Imunify360) to protect all customers. To maintain good email deliverability for everyone on our network:

• Only send email to recipients who have opted in or have an existing business relationship with you;
• Include a clear unsubscribe mechanism in marketing emails;
• Do not use misleading subject lines, sender names, or headers;
• Keep complaint and bounce rates low — accounts with consistently high spam complaint rates may be suspended to protect our shared mail servers' reputation.

For large marketing email campaigns, we recommend using a dedicated email marketing platform rather than sending bulk mail directly from your hosting account.

5Resource Usage & Fair Use

Shared, single-site, WordPress and email hosting plans are designed for typical website and business email usage, as described on our pricing page. While we don't actively monitor normal usage, accounts that consistently consume a disproportionate share of shared server resources (CPU, memory, I/O) — to the point of affecting other customers — may be asked to upgrade to a plan with dedicated resources (such as VPS hosting) or to optimise their application.

We will always try to contact you and offer solutions before taking any action on a resource-usage issue.

6Security Responsibilities

While we provide free SSL, daily backups, and Imunify360 malware protection on every plan, you are responsible for:

• Keeping your applications (WordPress, plugins, themes, scripts) updated to patched versions;
• Using strong, unique passwords for your hosting account, email accounts and applications;
• Enabling two-factor authentication where available;
• Promptly addressing any malware or compromise notifications from our security systems.

If your account is compromised and used to send spam or attack other systems, we may need to temporarily suspend it to protect other customers, while we work with you to resolve the issue.

7Reporting Abuse

If you believe content hosted with Nyasa Cloud violates this policy, please report it to hello@nyasacloud.mw with:

• The URL or domain of the content in question;
• A description of the violation;
• Any supporting evidence (screenshots, headers, etc.).

We investigate all reports and take appropriate action, which may include content removal, suspension, or law enforcement referral for serious violations such as CSAM.

8Enforcement

Depending on the severity and nature of a violation, we may:

• Contact you and request that the issue be corrected within a reasonable timeframe;
• Temporarily restrict or suspend the affected account or service;
• Remove specific offending content while leaving the rest of your account operational;
• Permanently terminate the account, without refund, for severe or repeated violations;
• Report illegal content (especially CSAM) to relevant law enforcement authorities, without prior notice to the account holder.

9Changes to This Policy

We may update this Acceptable Use Policy from time to time to address new types of abuse or changes in law. Updates will be posted on this page with a revised "Last updated" date.
