Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nyasa Cloud’s website, hosting, domain, email and related services. By creating an account, placing an order, or using any Nyasa Cloud service, you agree to be bound by these Terms.

1Acceptance of Terms

By accessing or using any part of the Nyasa Cloud website (nyasacloud.mw), client portal (host.nyasacloud.mw), or any hosting, domain, email, VPS, reseller, or licensing service we provide (collectively, the "Services"), you agree to these Terms of Service. If you are using the Services on behalf of a business or organisation, you confirm that you have the authority to bind that organisation to these Terms.

If you do not agree with any part of these Terms, please do not use our Services.

2Your Account

To use most of our Services, you must create an account in our client portal. You agree to:

  • Provide accurate, current and complete information when registering;
  • Keep your account credentials confidential and secure;
  • Notify us immediately at hello@nyasacloud.mw if you suspect unauthorised access to your account;
  • Be responsible for all activity that occurs under your account.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account with Nyasa Cloud.

3Services We Provide

Nyasa Cloud provides shared hosting, WordPress hosting, single-site hosting, email hosting, VPS hosting, reseller hosting, domain registration and transfer, and WHMCS billing licences. Specific features, storage, bandwidth and resource limits for each plan are described on our pricing page and individual service pages, and form part of these Terms by reference.

We may add, modify, or discontinue features of our Services from time to time. We will make reasonable efforts to notify you in advance of any change that materially reduces the functionality of a Service you are actively subscribed to.

4Payment & Billing

All fees are quoted and billed in Malawian Kwacha (MWK) unless otherwise stated. We accept payment via Airtel Money, TNM Mpamba, bank transfer (Standard Bank, National Bank), Visa and Mastercard.

  • Renewals: Services are billed in advance on a recurring basis (monthly or annually, as selected at checkout). Your plan renews at the same price you originally signed up at — we do not increase renewal pricing for existing subscriptions except where required by changes in underlying supplier costs, with 30 days' notice.
  • Late payment: If payment is not received by the due date, we will send reminder notices. Services may be suspended after a grace period if payment remains outstanding, as described in our Refund Policy.
  • Refunds: Refund eligibility, including our 30-day money-back guarantee, is set out in our Refund Policy.
  • Taxes: Prices exclude VAT and any other applicable taxes unless stated otherwise. You are responsible for any taxes applicable to your purchase.

5Domain Registrations

When you register or transfer a domain name through Nyasa Cloud, additional terms from the relevant domain registry (for example, the Malawi Network Information Centre for .mw and .co.mw domains, or ICANN-accredited registrars for gTLDs) may apply. We act as an intermediary between you and these registries.

  • You are responsible for providing accurate WHOIS/registrant information and keeping it up to date.
  • Domain registrations are typically non-refundable once processed, as set out in our Refund Policy.
  • Free WHOIS privacy is included on eligible domains, subject to registry rules — some country-code domains do not permit privacy protection.
  • It is your responsibility to renew your domain before expiry. We will send renewal reminders, but late renewal may result in temporary or permanent loss of the domain.

6Acceptable Use

Your use of our Services must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you may not use our Services to host or distribute illegal content, malware, spam, or content that infringes the rights of others, or to engage in activity that disrupts our network or other customers.

We reserve the right to investigate suspected violations and to take appropriate action, including content removal, suspension, or termination, as described in our Acceptable Use Policy.

7Suspension & Termination

We may suspend or terminate your access to the Services if:

  • Payment is overdue beyond the grace period;
  • You violate these Terms or our Acceptable Use Policy;
  • Your use of the Services poses a security risk to us or other customers;
  • We are required to do so by law or by a competent authority.

You may cancel your services at any time from the client portal or by contacting support. Cancellation does not automatically entitle you to a refund — see our Refund Policy for details. Upon termination, we may delete your hosted data after a reasonable grace period; we recommend maintaining your own backups at all times.

8Service Availability

We target 99.9% uptime across our hosting infrastructure, as described in our Service Level Agreement (SLA). Scheduled maintenance will be announced in advance via our News & Updates page where practical. Service credits for downtime that breaches our SLA commitments are described in the SLA document.

9Limitation of Liability

To the maximum extent permitted by applicable law, Nyasa Cloud and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, business opportunity or goodwill, arising from your use of (or inability to use) the Services.

Our total liability for any claim arising from these Terms or the Services is limited to the amount you paid us for the Service giving rise to the claim in the 3 months preceding the event. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

10Intellectual Property

The Nyasa Cloud name, logo, website design and content are the property of Nyasa Cloud and may not be copied, reproduced or used without our written permission, except as necessary to use the Services as intended.

You retain all rights to the content, websites, applications and data you host with us ("Customer Content"). By using our Services, you grant us a limited licence to store, process and transmit your Customer Content solely for the purpose of providing the Services to you.

11Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will post the updated Terms on this page with a revised "Last updated" date, and where changes are material, we will notify active customers by email at least 14 days before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12Governing Law

These Terms are governed by the laws of the Republic of Malawi. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Malawi, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
