These Terms of Service (“Terms”) govern your access to and use of Nyasa Cloud’s website, hosting, domain, email and related services. By creating an account, placing an order, or using any Nyasa Cloud service, you agree to be bound by these Terms.
By accessing or using any part of the Nyasa Cloud website (nyasacloud.mw), client portal (host.nyasacloud.mw), or any hosting, domain, email, VPS, reseller, or licensing service we provide (collectively, the "Services"), you agree to these Terms of Service. If you are using the Services on behalf of a business or organisation, you confirm that you have the authority to bind that organisation to these Terms.
If you do not agree with any part of these Terms, please do not use our Services.
To use most of our Services, you must create an account in our client portal. You agree to:
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account with Nyasa Cloud.
Nyasa Cloud provides shared hosting, WordPress hosting, single-site hosting, email hosting, VPS hosting, reseller hosting, domain registration and transfer, and WHMCS billing licences. Specific features, storage, bandwidth and resource limits for each plan are described on our pricing page and individual service pages, and form part of these Terms by reference.
We may add, modify, or discontinue features of our Services from time to time. We will make reasonable efforts to notify you in advance of any change that materially reduces the functionality of a Service you are actively subscribed to.
All fees are quoted and billed in Malawian Kwacha (MWK) unless otherwise stated. We accept payment via Airtel Money, TNM Mpamba, bank transfer (Standard Bank, National Bank), Visa and Mastercard.
When you register or transfer a domain name through Nyasa Cloud, additional terms from the relevant domain registry (for example, the Malawi Network Information Centre for .mw and .co.mw domains, or ICANN-accredited registrars for gTLDs) may apply. We act as an intermediary between you and these registries.
Your use of our Services must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you may not use our Services to host or distribute illegal content, malware, spam, or content that infringes the rights of others, or to engage in activity that disrupts our network or other customers.
We reserve the right to investigate suspected violations and to take appropriate action, including content removal, suspension, or termination, as described in our Acceptable Use Policy.
We may suspend or terminate your access to the Services if:
You may cancel your services at any time from the client portal or by contacting support. Cancellation does not automatically entitle you to a refund — see our Refund Policy for details. Upon termination, we may delete your hosted data after a reasonable grace period; we recommend maintaining your own backups at all times.
We target 99.9% uptime across our hosting infrastructure, as described in our Service Level Agreement (SLA). Scheduled maintenance will be announced in advance via our News & Updates page where practical. Service credits for downtime that breaches our SLA commitments are described in the SLA document.
To the maximum extent permitted by applicable law, Nyasa Cloud and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, business opportunity or goodwill, arising from your use of (or inability to use) the Services.
Our total liability for any claim arising from these Terms or the Services is limited to the amount you paid us for the Service giving rise to the claim in the 3 months preceding the event. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
The Nyasa Cloud name, logo, website design and content are the property of Nyasa Cloud and may not be copied, reproduced or used without our written permission, except as necessary to use the Services as intended.
You retain all rights to the content, websites, applications and data you host with us ("Customer Content"). By using our Services, you grant us a limited licence to store, process and transmit your Customer Content solely for the purpose of providing the Services to you.
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will post the updated Terms on this page with a revised "Last updated" date, and where changes are material, we will notify active customers by email at least 14 days before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Malawi. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Malawi, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
